Terms of Service
Who we are and what this covers
Carga is an AI-assisted training app. These terms cover the Carga mobile app, this website, and the personal-trainer marketplace. By creating an account you agree to them. If you use Carga on behalf of a business, you confirm you may bind that business.
Carga is not medical advice
Carga generates training programs from information you provide. It is fitness guidance, not medical advice, diagnosis, or treatment, and it does not replace a doctor or physiotherapist. Consult a qualified professional before starting any training program, especially if you have an injury, a medical condition, or are pregnant. Physical training carries inherent risk of injury — you train at your own risk, and you are responsible for judging whether a prescribed exercise, load, pace, or intensity is safe for you on the day. Stop and seek help if something hurts.
Your account
You need an account to use Carga. Keep your credentials secure and tell us promptly if you suspect unauthorised access. You must be at least 18, or the age of majority where you live. One person per account — do not share it.
Free and Pro plans
The free plan is a complete product, not a trial: a generated program, set-by-set session tracking, and the full exercise library, with some usage limits. Pro removes those limits for a recurring fee. Pro is billed through the Google Play Store or the Apple App Store, not by us directly — the store handles payment, renewal, and refunds under its own terms, and you manage or cancel the subscription in your store account. Cancelling stops future renewals; access continues to the end of the period you already paid for. Prices are shown in your local currency before you confirm, and we will give notice before any price change takes effect.
Hiring a personal trainer
The marketplace connects you with independent personal trainers. Every trainer is credential-checked (a valid CREF registration in Brazil, or a recognised certification such as NASM or ACE elsewhere) and identity-verified before their profile goes live. Trainers are independent professionals, not Carga employees or agents: the trainer — not Carga — is responsible for the coaching advice they give you, and is the advice-giver of record. We provide the platform, vetting, and payment processing. Coaching is billed monthly through Stripe; you can cancel any time and cancellation takes effect at the end of the period you have paid for. A trainer only sees your training data after you explicitly agree to share it, and you can revoke that access at any time.
If you are a trainer
Trainers keep 85% of every client payment; Carga charges a flat 15% platform fee. Payment processing fees are charged separately by Stripe and shown to you. Applying and staying listed are free. You are responsible for your own tax, for holding a valid credential for as long as you are listed, and for the advice you give. You must hold appropriate professional registration and keep client information confidential. We may suspend or remove a profile for a lapsed credential, a substantiated safety complaint, or a breach of these terms — and we will tell you why.
Acceptable use
Do not misuse Carga: no scraping or bulk extraction, no reverse engineering, no attempts to break authentication or access other people's data, no reselling access, and nothing unlawful. Do not use the coach chat to solicit medical advice or to generate content that is abusive or harmful. We may suspend accounts that do these things.
Your content and our software
Your training data is yours. You grant us only the limited permission needed to run the service for you — for example, sending the necessary context to our AI provider so the coach can answer. The app, the website, the exercise library, and the Carga name and branding remain ours. Feedback you send us may be used freely without obligation.
Availability and changes
We aim to keep Carga running but do not guarantee uninterrupted service, and AI features depend on a third-party provider that can be unavailable. Your logged training lives on your device and stays readable offline. We may change features, and we will give reasonable notice of material changes to these terms; continuing to use Carga after they take effect means you accept them.
Liability
Nothing here limits liability that cannot be limited by law — including, under Brazilian consumer law, liability for defects in the service or for damage we cause. Subject to that, Carga is not liable for injury arising from training you chose to perform, for the acts or advice of an independent trainer, or for indirect or consequential loss. Where liability is limited, it is limited to the amount you paid us in the twelve months before the claim.
Ending the agreement
You can stop using Carga and delete your account at any time from Settings, which erases your local training data on that device. We may end or suspend your access for a serious or repeated breach of these terms, with notice where practicable. Provisions that by their nature should survive — liability, intellectual property, and dispute terms — do.
Governing law
These terms are governed by the laws of Brazil. Consumer-protection rights under the Código de Defesa do Consumidor apply and are not waived by anything here — including your right to bring a claim in the courts of your own domicile.
Contact
Questions about these terms, your data, or a request to exercise your rights: contact us through the app (Settings → Help) or by email at the address published on carga.fit. We answer data-rights requests within 15 days, as required by the LGPD.
